UK Startup Visa

An individual can apply for a start-up visa if they are new entrepreneurs and want to establish an innovative business in the UK. They do not need to be a graduate or have initial funding. It is a one-off visa which is valid for 2 years. However, Start-up visa holders can extend their stay by switching to the Innovator visa category and will then qualify for ILR, three years later. They are eligible to bring their partner and any children under the age of 18 to the UK.

UK Innovator Visa

Experienced business persons looking to start a new business in the UK can apply for the Innovator visa. Mostly, the individual needs to have access to at least a £50,000 investment for their business. With that, they’ll also require an innovative, feasible and sustainable business idea, approved by an endorsing body. This visa is valid for 3 years and can directly lead directly to unlimited permission to stay in the UK when this period ends. Applicants can bring their partner and any children under the age of 18 to the UK.

REQUIREMENTS FOR STARTUP VISA

To qualify for a Start-up visa one will have to prove that they:

Are at least 18 years old;
Have not previously established a business in the UK
Have been endorsed by a UK-based higher education institution or a business organisation, which is historically known for supporting UK entrepreneurs
Have an endorsement letter was issued not more than 3 months before the date of their Start-up visa application;
Plan to commence, and are capable of undertaking, any work or business activity in the UK stated in their application;
Are proficient in the English language to at least CEFR Level B2 (equivalent to IELTS 5.5 in reading, writing, listening, and speaking);
Have at least £1270 to support themself, and £285 for a dependent partner, £315 for a first child and £200 for each additional child.

To qualify for a innovator visa one will have to prove that they:

Are at least 18 years old;
Have at least £50,000 investment
Have been endorsed by an approved UK endorsing body that has assessed the business idea for innovation, feasibility and scalability and is contented that they will spend the most of their working time in the UK on developing their business project;
Have an endorsement letter that was issued not more than 3 months before the date of their Innovator visa application;
Want to and are capable of undertaking, any work or business activity in the UK stated in their application;
Are competent in the English language to at least CEFR Level B2 (equivalent to IELTS 5.5 in reading, writing, listening and speaking);
Have at least £1270 to support themselves, plus £285 for a dependent partner, £315 for a first child and £200 for each additional child.
INVESTMENT FUNDS REQUIREMENTS

Start-up visa applicants don’t require any capital investment for their business but some endorsement companies need a definite amount of funds as a rule for endorsing

ENDORSEMENT CRITERIA

To get endorsement for a business idea, the endorsement body should be content with the business’ feasibility and sustainability. The endorsement body will have to be satisfied that the individual needs to give most of his to work on growing the business.

TEAM START-UP VISA

If there is a start-up team, each member will have to get his/her own endorsement by an official endorsement body.

START-UP VISA ENDORSEMENT LETTER

If the endorsement gets an approval, one will be given the letter of endorsement which needs to be given as a step of the application for visa.

ENDORSEMENT CRITERIA

To get endorsement for a business idea, the endorsement body should be content with the business’ feasibility and sustainability. The incumbent applying for the innovator visa will have to satisfy the endorsement body that most of his time will be dedicated to growing business in the UK.

SWITCHING TO INNOVATOR VISA CATEGORY

The Innovator visa application can be filed from both in and out the UK, given that individuals inside do not have, or were not last given, agreement as a Visitor, Short-term Student, Parent of a Child Student, Seasonal Worker, Domestic Worker in a Private Household or outside the Immigration Rules.

APPLYING FOR AN INNOVATOR VISA AS PART OF A TEAM

One can be a team’s member for a business but in that case, each individual needs an endorsement as well as individual funds of £50,000.

VALIDITY :
  • 3 years

CONDITIONS TO STAY:
  • Come up with more businesses as well.
  • Not allowed to work anywhere else other than their venture.
    • Any disguised employment will break the regulations of living.
CHECKPOINTS:

One will have to remain in communication with the endorsement organization and checking after 6, 12 and 24 months of success of the application.

The endorsement organization will have to become content with the individual continually working on the approved business and making progress as well. The endorsement may be withdrawn if conditions are not met at later stages.

INDEFINITE LEAVE TO REMAIN AS AN INNOVATOR

To meet the requirements for indefinite leave to stay as an Innovator:

  • Endorsement by an official UK endorsement organisation body being satisfied that the business has made substantial accomplishments as compared to the last assessment,
  • Registration with Companies House as a Director or Member of own business,
  • The venture is active, dealing and has sustainability for a minimum time of a year,
  • One has had an active working role in managing and growing the business and spends their whole operational time in the country on growing the business;

You satisfy at least two of the following:

  • £50,000 investment
  • Creation of 5 employments that have an average salary of at least £25,000 every 12 months;
  • Creation of at least 10 employments with no average salary;
  • Customers have gotten double in 3 years and are higher at the moment as compared to other similar businesses;
  • Issuance of application for protection of intellectual property in the UK;
  • Securing annual gross revenue of at least £1 million in the previous year;
  • Generation of annual gross revenue of £500,000 in the previous year, with at least £100,000 from exporting overseas;
  • One has been for not more than 180 days outside the UK in any rolling 12 month period during the 3 years preceding to the date of application;

 

 



UK Tier 2 Visa

UK Tier 2 Visa permits individuals to go and remain in the UK to work with an official company and this visa has substituted the Tier 2 (General) work visa. You may also work in an eligible job and study with their Tier 2 visa, do volunteer work, travel out of the country and come back as well as bring your family as dependents.

REQUIREMENTS:

To meet the requirements for a Skilled Worker visa, one needs to:
• be employed by an official UK employer
• have a sponsorship certificate from the employer with all the job details
• work in a permitted profession
• get paid the minimum salary; the amount depends on the profession
• be proficient in English to at least CEFR Level B2 (equivalent to IELTS 5.5 in reading, writing, listening and speaking);
• have a visa-eligible job
• provide a criminal record certificate
• get a salary of minimum £25,600 yearly or £10.10 hourly, either of which is more.
• have a minimum of £1,270 in bank to prove that he/she can sustain in the UK
• be able to pay the healthcare charges of £624/year
• have a minimum of £1270 to sustain himself/herself and £285 for a dependent partner, £315 for a first child and £200 for each additional child.

Validity:

UK Tier 2 Visa can be considered valid for 5 years before one can get an extension. You will have to file an application to get an extension or updated visa when it is expiring or if you switch the job or employer. Not only that, you can also file application for indefinite leave to remain after 5 years, if eligible.

Application Fee:

Outside the UK: £625/ person for 3 years and £1,235/ person for more than that.
Inside the UK to extend, switch or update their visa: £719/person for up to 3 years and £1,423/ person for more than that.
Extend your visa
One can file an application to get an extension for a Skilled Worker visa or a Tier 2 (General) work visa if he/she:
• has the same job as when got previous consent to come or remain in the UK
• has a job is in the same profession code as when given the last consent to come or remain in the UK
• is still employed by the organization that provided their current certificate of sponsorship
Potential incumbents are recommended to not travel abroad until a verdict is received. In that case, the application will be withdrawn as and when deemed appropriate by the regulatory bodies.
